By reserving a charter or using our Service, you consent to adhere to these Terms. If you oppose any section of these terms, you should refrain from using the Service.

2. Service Overview

MintBrushHouse offers exclusive yacht rental services, which include among others:

• Daily yacht hire
• Evening cruises
• Business retreats
• Exclusive gatherings
• Extended charters

All services are offered based on their availability and are contingent on weather conditions. We retain the discretion to alter or cease services whenever necessary.

3. Booking and Reservations

3.1 Booking Process

To confirm a charter, the participant must:

• Be no less than 18 years old
• Provide precise and comprehensive details
• Remit the necessary down payment as outlined in your reservation confirmation
• Concur with these Terms & Conditions

3.2 Confirmation

Your reservation is deemed confirmed after the payment is received alongside our note of confirmation. We hold the prerogative to decline service to anyone as we see fit.

3.3 Availability

All charters hinge on the accessibility of the vessel and appropriate weather conditions. Efforts will be made to accommodate your requested dates and timings.

4. Payment Terms

4.1 Pricing

All prices are stated in € and cover relevant taxes unless specified otherwise. Prices are subject to modifications without prior notification.

4.2 Payment Schedule

• Deposit: 50% of the total cost of the charter required at the time of booking
• Balance: Payable 48 hours before departure
• Incidental charges (if applicable): Payable upon the charter's conclusion

4.3 Payment Methods

We accept major credit cards, wire transfers, and certified bank drafts. Transactions are executed using secure, encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• With a notice exceeding 72 hours before departure: Full reimbursement minus transaction charges
• Between 24 to 72 hours before departure: 50% reimbursement
• Under 24 hours prior to departure: No reimbursement

5.2 Weather Cancellations

In the case that the captain deems weather conditions as unsafe, we will propose to:

• Rebook your charter to an alternative date without extra charges
• Issue a complete refund if rebooking is impractical

5.3 Mechanical Issues

If there are mechanical issues with the designated vessel, we will strive to provide an acceptable replacement. If substitution is not feasible, a full refund will be granted.

6. Safety and Conduct

6.1 Safety Requirements

Each passenger must:

• Heed all instructions from the crew
• Utilize the safety gear as needed
• Disclose any health conditions that may influence their safety
• Stay within the assigned areas on the vessel

6.2 Prohibited Items

Items forbidden aboard include:

• Containers made of glass
• Illicit materials
• Guns or other weapons
• Excessive consumable items (beyond moderate intake)
• Animals (unless pre-approved)

6.3 Conduct

Passengers should act considerately and respectfully. We reserve the right to terminate charters prematurely and without reimbursement if passenger behavior creates a hazard or disturbs others.

7. Liability and Insurance

7.1 Our Liability

We are liable to the extent of the amount paid for your charter. We are not accountable for:

• Injuries caused by passenger's negligence
• Lost or damaged personal items
• Indirect, consequential, or punitive losses
• Delays occasioned by weather or events beyond our control

7.2 Insurance Coverage

We maintain comprehensive maritime insurance for our fleet and operations. It is your responsibility to have personal travel and accident insurance.

7.3 Assumption of Risk

Engaging in our yacht services signifies your acceptance of the inherent risks involved in waterborne activities, and you accept responsibility for your safety and physical state.

8. Modifications and Itinerary Changes

We retain the right to adjust the itineraries, paths, or schedules due to weather, safety concerns, or operational needs. We will endeavor to arrange comparable alternative experiences.

9. Force Majeure

We are not responsible for interruptions, abolition, or changes brought about by circumstances not within our sway, such as but not limited to:

• Intense meteorological events
• Natural calamities
• Governmental decrees
• Ports being closed
• Mechanical breakages

10. Privacy and Data Protection

Your private information is managed in alignment with our Privacy Policy. By utilizing our services, you consent to the collection and usage of your data as delineated in our Privacy Policy.

11. Intellectual Property

All content found on our website, inclusive of writings, imagery, symbols, and photographs, fall under copyright and trademark regulations. You are prohibited from reproducing, propagating, or creating derived content without our explicit permission.

12. Governing Law

These Terms are regulated by the laws in force within Germany. Any disputes will be settled in the courthouses of Hamburg, Germany.
